How are retirement accounts handled in a divorce?
Retirement accounts accumulated during the marriage — including 401(k)s, pensions, and IRAs — are generally considered marital property and subject to division. A Qualified Domestic Relations Order (QDRO) may be required to divide these assets without tax penalties. What is spousal maintenance and how is it calculated?
Spousal maintenance (formerly known as alimony) is financial support paid by one spouse to the other after a divorce. Illinois uses a formula based on both parties' income and the length of the marriage to determine the amount and duration.
